IN THE SUPREME COURT OF INDIA

INHERENT JURISDICTION

CONTEMPT PETITION(CIVIL) NO.106/2025

IN

SPECIAL LEAVE PETITION (CIVIL) NO. 10598/2024

PRIYAMBADA PATTANAIK Petitioner(s)

VERSUS

S. ASWATHY Alleged Contemnor(s)Respondent(s)

O R D E R

1. The petitioner before us was appointed as a Homeopathic

Medical Officer in the year 1996 on contractual basis.

2. Later, the services of all Homeopathic Medical Officers were

ordered to be regularized with effect from their initial

appointment.

3. This Court in its Order dated 16th April 2024 had observed

that the actual benefit of regularization shall entail from the

date of their orders of regularization.

4. It is not in dispute that the order of regularization in

context with the present case was passed sometime in 2008. The

benefits would be notional insofar as regularization from the date

of appointment till the order of regularization is passed. Later,

thereafter, actual benefits had to be granted.

5. The learned counsel appearing for the petitioner submitted

that order has been by and large complied with insofar as

2

regularization is concerned. However, the petitioner has some

grievance with regard to fixation of her grade pay.

6. In this regard, the petitioner has already preferred a

representation addressed to the competent authority.

7. We dispose of this Contempt Petition directing the competent

authority to look into the representation preferred by the

petitioner in regard to her fixation of grade pay and take an

appropriate decision in accordance with the Rules and Regulations

within a period of four weeks from today.

8. The decision shall be communicated in writing to the

petitioner. If the petitioner is aggrieved in any manner by the

decision that may be taken with respect to her fixation of grade

pay, it shall be open for the petitioner to avail appropriate legal

remedy before the appropriate forum in accordance with law.

9. Pending applications, if any, also stand disposed of.
